Immediately after representation begins,
we start gathering information about
your case. All healthcare providers
are contacted and all insurance coverage
is verified. A medical billing balance
log is created. Information gathering
may include obtaining witness statements,
digital images and governmental reports.
Each file is opened with a twenty-eight-point
checklist. Information gathering may
continue throughout the course of representation.
Medical malpractice or medical negligence
cases require additional information
to be gathered. Prior to bringing a
claim, Florida law requires a physician
or other appropriate healthcare provider
review the relevant medical records
and render a sworn written opinion
that negligence occurred. The potential
defendant doctor or hospital must be
provided a copy of the opinion and
allowed 90 days to consider resolution.
This aspect of a medical malpractice
claim is referred to as the pre-suit
process. Medical malpractice claims
can be particularly time consuming
and costly to pursue.
